With the standard of roads in South Africa deteriorating rapidly and the government’s general lack of concern about this, as well as the alarming lack of control over unskilled drivers, coupled with a general disregard for bikers and cyclists in general, thousands of accidents occur on South African roads on a daily basis. The Road Accident Fund, is a statutory body created to compensate innocent victims of road accidents, and is funded by a fuel levy that you contribute to. The RAF has adopted a change in the regulations governing the Road Accident Fund Act. These changes were designed to severely limit and curtail the compensation victims can claim from the RAF. The most important and devastating of these changes by far, is the abolition of your Common Law right to sue the wrongdoer for the balance of your damages not covered by the RAF. These new Regulations are currently the subject of an application to the Constitutional Court. We at De Meyer & De Vries are committed to fight against this injustice.
